These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “Vendor”, “Renter”, or “you”) and Namma Thalluvandi (“NTV”, “we”, “us”, or “our”), governing your access to and use of www.nammathalluvandi.in and associated communication services.

By browsing the website, submitting an enquiry, publishing a cart listing, subscribing to a vendor plan, or utilizing our services, you confirm that you accept these Terms and agree to comply with them. If you do not agree to these Terms, you must not use our website or services.

You must be at least 18 years of age and possess the legal capacity under Indian law to enter into binding contracts. By using this platform, you represent and warrant that:

• All information you submit (including name, phone number, business proof, and cart details) is true, accurate, current, and complete.
• You will maintain the accuracy of such information and promptly update it if changes occur.
• You are solely responsible for maintaining the confidentiality of any login sessions or OTP verification tokens.
• Your use of the platform does not violate any applicable local, municipal, state, or national laws.

Namma Thalluvandi provides a venue where cart owners (vendors) can list their equipment, and prospective food entrepreneurs (renters/buyers) can discover, compare, and initiate contact with vendors.

All rental or sale agreements, commitments, and commercial transactions are formed directly between the cart vendor and the customer/renter.

• Private Negotiation: Key terms—including daily or monthly rental rates, security deposits, payment schedules, rental duration, transportation and pickup arrangements, maintenance responsibilities, damage deductions, and refund conditions—are negotiated directly between the renter and the vendor.
• Not a Party: Namma Thalluvandi is not a party to, nor an agent in, any private rental or sale contract entered into between independent vendors and customers, unless explicitly stated for our direct Ondipudur yard inventory.
• Inspection & Verification: Renters are strongly advised to inspect the physical condition, burner setups, wheels, cleanliness, and legal compliance of any cart in person before paying deposits or entering into an agreement.

Vendors who submit or publish cart listings on Namma Thalluvandi agree to the following obligations:

• You must own the cart or possess explicit authorized legal rights from the owner to list and rent it.
• All photographs, pricing, dimensions, equipment details, and availability statuses must be authentic and reflect the actual cart.
• You must clearly disclose any defects, maintenance issues, or usage restrictions.
• You must promptly update listing statuses when a cart becomes booked, unavailable, or sold.
• You agree to treat all prospective customers with professionalism and honesty.

Namma Thalluvandi offers optional paid vendor subscription plans to provide enhanced platform visibility, featured slots, and listing management features. The current official subscription tiers are:

* All subscription fees are inclusive of applicable digital platform service taxes. NTV reserves the right to adjust pricing with advance notification prior to subsequent billing cycles.

Namma Thalluvandi utilizes Razorpay as its authorized payment gateway for processing vendor subscription transactions.

• Supported Methods: Payments can be completed using UPI, Debit Cards, Credit Cards, Net Banking, and other payment modes supported by Razorpay.
• Payment Security: NTV does not store or process complete card credentials, banking passwords, or UPI PINs. All payment transactions are executed on Razorpay's encrypted, PCI-DSS compliant infrastructure.
• Activation: Subscription features and listing enhancements are activated only upon successful confirmation of payment receipt from the payment gateway. Payment gateway timeouts, network drops, or bank declines may prevent automatic activation.

Subscription plans are valid strictly for the duration selected at the time of purchase (e.g., 30 days for 1-month plans, 90 days for 3-month plans).

Upon expiration of a subscription term, vendor listings may revert to standard unpromoted visibility until renewed. Vendors may renew their plans at any time through their vendor portal or by contacting support.

Because subscription plans grant immediate digital access to platform visibility, listing slots, and promotion tools:

• Non-Refundable: Subscription payments are non-refundable once the plan has been activated, except in verified cases of duplicate billing or technical failure where services were completely inaccessible.
• Cancellation: You may choose not to renew your subscription for the following cycle. Cancellation does not provide retroactive pro-rata refunds for the unused remainder of an active subscription period.
• Dispute Resolution: If you believe an erroneous charge has occurred, contact support@nammathalluvandi.in within 5 business days with payment order references for review.

Subscription tiers include specific feature allocations such as:

Customer interest depends on various external market factors beyond our control, including your cart condition, competitive pricing, seasonal demand, location, responsiveness, and customer preferences.

NTV may display featured badges, top placement banners, or social media highlights for eligible vendor tiers. Featured placements are subject to periodic rotational scheduling and category relevance to ensure fairness across vendors.

Namma Thalluvandi facilitates connections by generating direct WhatsApp enquiry links. When users and vendors communicate via WhatsApp or external phone calls:

• Users communicate directly under their own discretion and responsibility.
• NTV does not moderate, monitor, or record private chat conversations between independent parties.
• Users must exercise standard commercial caution and verify counterparties before making advance cash transfers or sharing confidential documents.

Both vendors and renters are solely responsible for ensuring that their commercial street food operations comply with all relevant local regulations, municipal corporation vending norms, fire safety requirements, and food safety standards (such as FSSAI registration where applicable).

When using Namma Thalluvandi, you agree not to engage in any of the following prohibited conduct:

• Posting false, misleading, fraudulent, or deceptive cart specifications or pricing.
• Listing stolen property, counterfeit equipment, or items that you have no legal authority to rent or sell.
• Harassing, threatening, or abusing other platform users, vendors, or NTV support staff.
• Using automated scraping, crawling, bots, or data mining software to extract platform data.
• Attempting to compromise the security, integrity, or infrastructure of the website or payment processing flows.
• Impersonating another business, vendor, or Namma Thalluvandi representative.

All website design, logos, graphics, brand assets, source code, UI components, text content, and trademarks associated with Namma Thalluvandi are the proprietary property of NTV and are protected by applicable intellectual property laws.

By submitting photographs and listing text to our platform, you grant NTV a non-exclusive, royalty-free, worldwide license to display, optimize, and promote your listings across our website and marketing channels.

We endeavor to maintain continuous website uptime and responsiveness. However, we do not guarantee uninterrupted, error-free, or 100% continuous platform availability. The website may be temporarily unavailable due to scheduled maintenance, system upgrades, technical faults, or hosting infrastructure outages.

To the maximum extent permitted by applicable law, Namma Thalluvandi, its operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, business interruption, loss of data, cart damage, theft, personal injury, or disputes arising between vendors and renters.

In all circumstances, NTV's aggregate liability arising out of or related to your use of the platform shall not exceed the total subscription fee amount paid by you to NTV in the 3 months preceding the claim.

We reserve the right to immediately suspend, deactivate, or terminate your listing, account, or access to Namma Thalluvandi without prior notice if you violate these Terms, provide fraudulent information, engage in abusive behavior, or if your listing receives verified customer complaints.

We reserve the right to modify, enhance, update, or discontinue features, layout, subscription offerings, or operational rules at our sole discretion. Any material changes to these Terms will be posted on this page with an updated “Last Updated” date. Continued use of the platform following modifications constitutes your acceptance of the revised Terms.

Your access to and use of our platform is also governed by our Privacy Policy, which explains how we collect, handle, and protect your personal information. By agreeing to these Terms, you also acknowledge and agree to our Privacy Policy.

These Terms & Conditions shall be governed by, construed, and enforced in accordance with the laws of the Republic of India. Any legal disputes or claims arising out of or in connection with these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the competent courts in Coimbatore, Tamil Nadu, India.
